- WIRELESS CARRIERS ARE NOT LIABLE FOR DELAYED OR UNDELIVERED MESSAGES
- WE CANNOT GUARANTEE THE SECURITY OF SMS TRANSMISSIONS, AND YOU ASSUME ALL RISK OF USING SMS SERVICES
- MESSAGE AND DATA RATES MAY APPLY TO YOUR USE OF SMS SERVICES, AND WE ARE NOT RESPONSIBLE FOR ANY CHARGES YOU INCUR
Basis of the Bargain
THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND YOU.
Exclusions

YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
c) Governing Law
This Privacy Policy and any disputes arising from or relating to this Privacy Policy or your use of the Services shall be governed by Delaware law, without regard to conflict of law principles.
